Copyright notices
NavEd Network lists courses that teachers built. If you believe one of them uses your copyrighted work without permission, this page says how to tell us, what we do next, and what happens to the teacher whose course is involved.
This page describes NavEd's own policy and process. It is not legal advice.
How to report material you believe infringes your copyright
Use the form linked at the bottom of this page, or write to our designated agent below. Under 17 U.S.C. 512(c)(3), a notice needs to include all of the following. Without them we may not be able to act on it.
- Identify the work. Say which copyrighted work you believe was used. If several of your works are involved in one course, a representative list is enough.
- Identify the material and where it is. Give us the link to the course, or enough detail that we can find the material without guessing.
- Tell us how to reach you. Your name, mailing address, telephone number and email address.
- State your good-faith belief. That you believe in good faith this use is not authorized by you, your agent, or the law.
- State that your notice is accurate. That the information in it is accurate, and, under penalty of perjury, that you are the owner of the work or are authorized to act for the owner.
- Sign it. A physical or electronic signature. Typing your full legal name in the form counts as your signature.
What happens after you send one
Your notice is recorded and it reaches a person at NavEd. Sending it does not by itself remove or hide anything.
A person reads it. While we look into it we may pause the course listing. Pausing takes it out of the catalogue so nobody new can buy it. Families who already bought the course keep their access unless we go on to confirm the material has to come down.
If we do confirm that, we take the listing down, refund the families who bought it, and tell them in plain words why.
If your course was paused
If you are the teacher whose listing was paused, we tell you. We say what was claimed and who claimed it, and you can write back to us about it.
If you believe your material was paused or removed because of a mistake or a misidentification, you can send a counter-notification. Under 17 U.S.C. 512(g)(3) it needs to include:
- Your signature, physical or electronic.
- The material that was paused or removed, and where it appeared before that happened.
- A statement, under penalty of perjury, that you have a good-faith belief the material was paused or removed as a result of mistake or misidentification.
- Your name, address and telephone number.
- A statement that you consent to the jurisdiction of the Federal District Court for the district where you live, or, if you live outside the United States, of any judicial district in which NavEd may be found, and that you will accept service of process from the person who sent the notice or from their agent.
We pass your counter-notification to the person who sent the notice. If they do not tell us within 10 to 14 business days that they have gone to court to stop you using the material, we may put your listing back.
Repeat infringement
We terminate the accounts of people who repeatedly infringe someone else's copyright. The law requires us to have that policy and to act on it, so we do.
